A service apartment in Malaysia usually sits on land approved for commercial use, while a condominium sits on land approved for residential use; both are strata units run under the Strata Management Act 2013. That title difference drives quit rent, assessment and utility billing. On SuperHomes listings, service residences are smaller and cost more per square foot (September 2026).
The building can look identical. The legal paperwork behind it does not, and the differences only show up in your bills, your loan paperwork and your buyer pool when you sell. Every regulatory figure below was checked against its primary source on 30 September 2026.

Why the Land Title Is the Real Difference
A service apartment and a condominium both sit on "building" category land, because the National Land Code recognises only three land use categories: agriculture, building and industry (National Land Code, s.52, checked 30 September 2026). The difference is the express condition and planning approval attached to that land, which for most service apartments allows commercial use.
Developers typically build service apartments on land zoned for commercial development, often inside mixed projects with a retail podium or offices. That approval travels with the strata title for the life of the building. It is why your quit rent notice, assessment bill and some utility accounts can be charged at non-residential rates even though you live there.
Before you sign, ask for a copy of the master title or the strata title and read the land use category and express condition. The sale and purchase agreement and the lawyer's title search will state it; "service residence", "serviced suite" or "residences" in the marketing name does not.
Buyer Protection: HDA and the Schedule H SPA
A service apartment built for people to live in is covered by the Housing Development (Control and Licensing) Act 1966, because the 2007 amendment (Act A1289) rewrote the definition of "housing accommodation" and dropped the old exclusion for accommodation on land approved for commercial development (Act A1289, checked 30 September 2026). Before that amendment, units on commercial land fell outside the Act.
In practice, check three things:
- The SPA is the statutory Schedule H form for a strata unit sold by a licensed housing developer.
- The developer holds a housing developer's licence and advertising permit for the project.
- Your disputes can go to the Tribunal for Homebuyer Claims, whose jurisdiction is limited to claims arising from a sale and purchase agreement between a homebuyer and a housing developer, in Peninsular Malaysia and Labuan (KPKT, checked 30 September 2026).
SOHO, SOFO and SOVO units are marketed as office or mixed-use space and can sit outside these protections; our guide to SOHO, SOFO and SOVO in Malaysia covers those separately.
Utilities: What TNB Actually Charges
TNB classifies an electricity account by the activity at the premises, not by the land title: a "domestic consumer" is one occupying a private dwelling not used for business, and a consumer can apply at a Kedai Tenaga to change tariff, signing a new agreement and paying stamp duty on it (TNB, checked 30 September 2026). So a service apartment you live in is not automatically stuck on a commercial electricity tariff.
What to check before buying:
- Whose name is on the TNB account. If each unit has its own TNB account, ask the seller which tariff category the bill shows.
- Whether the building is bulk-supplied. If electricity or water comes through the management rather than your own account, your rate is whatever the management charges. Ask for the last three bills.
- Water. Water operators set their own domestic and commercial tariffs; the same bill check applies.
Quit Rent, Assessment and Maintenance Fees
Quit rent (cukai tanah) is set by the state for the land category and use, and assessment (cukai taksiran) is set by the local council on the property's value and use; both can be charged at commercial rates for a service apartment. Rates vary by state and council, so ask the seller for the latest quit rent and assessment bills rather than relying on an agent's estimate.
Maintenance works the same way in both building types. Under the Strata Management Act 2013, the Charges are shared in proportion to each parcel's share units, and the sinking fund contribution must be at least 10% of the Charges (Strata Management Act 2013, checked 30 September 2026). Service apartments with hotel-style facilities, concierge or larger commercial podiums often carry higher Charges per square foot; our guide to strata maintenance fees and the sinking fund explains how they are set and challenged.
Financing, EPF and Stamp Duty
Service apartments qualify for the same EPF housing withdrawals as condominiums: KWSP's list of eligible residential properties for its monthly housing loan instalment withdrawal names serviced apartments, and also SOHOs, which must be applied for at a KWSP branch (KWSP, checked 30 September 2026). Bank financing is decided by each lender's credit policy, so ask for the approved margin in writing before you pay the booking fee.
Stamp duty on the transfer uses the same tiers for Malaysians: 1% on the first RM100,000, 2% up to RM500,000, 3% up to RM1,000,000 and 4% above (Stamp Act 1949, First Schedule item 32(a)). For foreigners, the Stamp Act defines "residential property" to include a service apartment used solely as a dwelling, so the flat 8% from 1 January 2026 applies to service apartments too (Stamp Act 1949, s.2 and item 32(ab)). Stamp duty exemption orders carry their own definitions, so confirm with your lawyer before counting on a first-home exemption for a service apartment.
SuperHomes Data: Smaller Units, Higher Price per Square Foot
Service residences listed for sale on SuperHomes are about a third smaller than condominiums and cost more per square foot: in Kuala Lumpur, the median service residence asks RM489 psf for 743 sq ft, against RM431 psf for 1,073 sq ft for a condominium (SuperHomes visible for-sale listings, 30 September 2026).
| Visible for-sale listings, 30 Sep 2026 | Listings | Median asking price | Median price per sq ft | Median built-up |
|---|---|---|---|---|
| Kuala Lumpur, condominium | 63 | RM504,000 | RM431 | 1,073 sq ft |
| Kuala Lumpur, service residence | 51 | RM405,000 | RM489 | 743 sq ft |
| Selangor, condominium | 44 | RM372,400 | RM270 | 1,513 sq ft |
| Selangor, service residence | 67 | RM369,000 | RM364 | 1,000 sq ft |

Two readings matter for buyers. First, the lower ticket price of a service apartment usually buys less space, not a bargain: in Kuala Lumpur you pay 13% more per square foot for a unit 31% smaller. Second, service residences are now as common as condominiums in SuperHomes' Klang Valley sale listings, so resale buyers have plenty of comparable stock to choose from. Compare live listings on the Kuala Lumpur property page.
Worked Example: RM450,000 in Kuala Lumpur
Here is what RM450,000 buys at the Kuala Lumpur medians above, bought by a Malaysian citizen. The maintenance rates are illustrative assumptions for comparison, not market figures; use the building's actual Charges.
| Item | Condominium | Service apartment |
|---|---|---|
| Space at KL median psf | RM450,000 / RM431 = 1,044 sq ft | RM450,000 / RM489 = 920 sq ft |
| MOT stamp duty (citizen) | RM1,000 + RM7,000 = RM8,000 | RM1,000 + RM7,000 = RM8,000 |
| Illustrative Charges | 1,044 x RM0.30 = RM313 a month | 920 x RM0.40 = RM368 a month |
| Sinking fund (10% of Charges) | RM31 a month | RM37 a month |
| Monthly strata cost | RM344 | RM405 |
The service apartment gives 124 sq ft less space for the same price and, on these assumptions, RM61 a month more in strata costs, before any difference in quit rent, assessment or utility tariff. That is RM732 a year you should either negotiate off the price or justify with location, rental demand or facilities.
Common Mistakes Buyers Make
- Trusting the marketing name. "Residences" or "suites" says nothing about the title; the land use condition does.
- Assuming commercial utility rates are permanent. A dwelling can apply to TNB for the domestic tariff if the account is in the owner's name.
- Skipping the bills. Quit rent, assessment and utility bills show the real running cost; ask for the last year.
- Comparing asking prices instead of price per square foot. A cheaper service apartment is usually a smaller one.
- Confusing service apartments with SOHO or SOFO units, which are marketed as office space and can sit outside housing protections.
- Assuming a first-home stamp duty exemption applies without the lawyer confirming the exemption order's definition.
Frequently Asked Questions
Q: What is the difference between a service apartment and a condominium in Malaysia?
A service apartment usually sits on land approved for commercial use, while a condominium sits on land approved for residential use. Both are strata units managed under the Strata Management Act 2013, but the commercial approval can mean higher quit rent, assessment and utility charges.
Q: Is a service apartment commercial or residential property?
The land is usually commercial, but the unit is built for living in. The Housing Development Act has covered such accommodation since the 2007 amendment, and the Stamp Act 1949 treats a service apartment used solely as a dwelling as "residential property".
Q: Do service apartments pay commercial electricity rates?
Not necessarily. TNB classifies accounts by the activity at the premises, and a unit used as a private dwelling can apply at a Kedai Tenaga for the domestic tariff (TNB, checked 30 September 2026). If the building is bulk-supplied through the management, your rate depends on the management's billing.
Q: Can I use EPF to buy or pay for a service apartment?
Yes. KWSP lists serviced apartments among the residential properties eligible for its housing loan instalment withdrawal from Akaun Sejahtera, subject to the usual conditions such as being under 55 (KWSP, checked 30 September 2026).
Q: Are service apartments protected under the Housing Development Act?
Yes, when they are built for habitation and sold by a licensed housing developer. The 2007 amendment (Act A1289) removed the old exclusion for accommodation on commercial land. Check that your SPA is the Schedule H form.
Q: Is a service apartment a good investment compared with a condominium?
It depends on rental demand and running costs. On SuperHomes' September 2026 Kuala Lumpur listings, service residences asked 13% more per square foot for units 31% smaller, so the rent has to cover a higher cost per square foot and possibly higher strata and utility bills.
Q: Do foreigners pay the 8% stamp duty on service apartments?
Yes. From 1 January 2026, foreign individuals and foreign companies pay a flat 8% on residential property, and the Stamp Act's definition of residential property includes a service apartment used solely as a dwelling.
