How is stamp duty calculated on a property purchase in Malaysia?

Stamp duty on the Memorandum of Transfer (MOT) is charged on a progressive scale: 1% on the first RM100,000, 2% on the next RM400,000 (RM100,001–RM500,000), 3% on the next RM500,000 (RM500,001–RM1,000,000), and 4% on any amount above RM1,000,000 — charged on whichever is higher, the purchase price or the market value. A separate loan agreement duty of 0.5% applies if you’re financing the purchase, and the Sale & Purchase Agreement itself carries a flat RM10 duty.

Do foreigners pay a different stamp duty rate in Malaysia?

Yes. Non-citizens and non-permanent-residents pay a flat 8% stamp duty on the transfer of residential property, effective for transfers executed on or after 1 January 2026 — up from the previous flat 4% rate. Malaysian permanent residents (PR) are exempt from this surcharge and use the standard progressive citizen rates instead. Commercial and industrial property purchases are not affected by the foreign-buyer surcharge.

Am I eligible for the first-time homebuyer stamp duty exemption?

Malaysian citizens buying their first residential property, priced or valued at RM500,000 or below, qualify for a 100% exemption on both the MOT stamp duty and the loan agreement stamp duty. The exemption applies to Sale & Purchase Agreements executed on or before 31 December 2027. It is restricted to Malaysian citizens — Malaysian PRs and foreign buyers do not qualify, regardless of price.
