How are legal fees for buying a property calculated in Malaysia?

Conveyancing fees follow the Solicitors' Remuneration Order 2023, in force since 15 July 2023. For the Sale and Purchase Agreement (SPA) the scale is 1.25% on the first RM500,000 of the price (minimum RM500) and 1% on the next RM7,000,000. Above RM7,500,000 the fee on the excess is negotiable but may not exceed 1%. The loan agreement is charged on the same scale, calculated on the loan amount. 8% Service Tax is added on top of both.

Are legal fees lower when I buy from a developer?

Yes. Sales governed by the Housing Development Act, which covers buying a new unit from a licensed developer, use the discounted Table B scale: a flat RM500 up to RM50,000, then 75% of the standard fee up to RM250,000, 70% up to RM500,000, 65% up to RM1,000,000 and 50% above that. The same discounts apply to the loan documents for that purchase. Many developers also offer to pay the SPA legal fee as a promotion.

What is not included in this estimate?

The calculator covers the regulated professional fees and SST only. It excludes disbursements such as land and bankruptcy searches, registration, filing and courier costs (typically a few hundred to over a thousand ringgit), stamp duty on the transfer and loan, fees for extra security documents, and fixed fees for state consent or caveats. Ask your lawyer for an itemised quotation.

Can lawyers give a discount on the scale fee?

The scale sets the fee for the work, and the Malaysian Bar treats undercutting it as a professional conduct issue, so the percentage itself is generally not negotiable below RM7.5 million. You can still compare disbursement charges between firms, and look out for developer packages that absorb the SPA legal fee.
