# Strata Title vs Individual Title Malaysia 2026: Key Differences

**Strata Title vs Individual Title Malaysia 2026: Key Differences**

An **individual title** (*hakmilik individu*) means you own a plot of land and the house on it, registered under the National Land Code. A **strata title** (*hakmilik strata*) means you own one parcel in a subdivided building or piece of land, plus a share of the common property, under the Strata Titles Act 1985. Before either is issued, a new development sits on the developer's **master title**, and land that has not yet been surveyed carries a **qualified title** rather than a **final title**.

When buying residential property in Malaysia, the title type decides what you actually own, who maintains the building, what you pay every month and how quickly you can sell or refinance. This guide explains all five title terms you will meet in an SPA or a land search, the rules developers must follow to issue strata titles, perfection of transfer and charge, and how maintenance fees are calculated under the **Strata Management Act 2013**.

## Title Types Explained: Master, Qualified, Final, Individual and Strata

| Title Term | What It Means | What It Means for You |
| :--- | :--- | :--- |
| **Master title** (*hakmilik induk*) | One title over the whole development land, held by the developer | You do not appear on any title yet. Your ownership rests on the SPA, and your bank takes an **assignment** of your rights instead of a registered charge |
| **Qualified title** (*hakmilik sementara*, shown as HS(D) at the Land Registry or HS(M) at the District Land Office) | Title issued before the land's final survey is complete | The land is registered and can be sold or charged, but boundaries are not yet finalised |
| **Final title** (*hakmilik tetap*: Geran, Pajakan Negeri, Geran Mukim or Pajakan Mukim) | Title issued after the land is surveyed | Boundaries are fixed. A developer must hold a final title before it can apply for strata titles |
| **Individual title** | A separate final title for one subdivided lot | You own land and house outright |
| **Strata title** | A title for one parcel in a strata scheme | You own the parcel and share units in the common property |

The qualified-to-final step matters because the land must be under **final title**, free of any charge or other encumbrance, and (if leasehold) have at least **21 years** left on the lease before strata titles can be applied for. (Source: JKPTG, *Soalan Lazim: Hakmilik Strata*; checked 30 Sep 2026.) A development stuck on a qualified title will not get strata titles until the survey is done.

The National Land Code governs land in Peninsular Malaysia, including states such as Johor, Selangor and Penang, while Sabah and Sarawak have their own land laws. Title documents are issued by each state's land office (*Pejabat Tanah dan Galian*). (Source: JKPTG, Kanun Tanah Negara page; checked 30 Sep 2026.) A Johor terrace on "individual title" is therefore registered under the same Code as one in Selangor.

### Buying Under a Master Title

If you buy a unit whose strata or individual title has not been issued, you are buying the developer's contractual promise, not a registered interest. For a subsale, the seller **assigns** their SPA rights to you through a **Deed of Assignment (DOA)**, usually with the developer's consent, and your bank takes a fresh assignment as security. When titles are finally issued, the chain of assignments must be converted into a registered transfer, which is **perfection of title** (section 1). Expect a subsale under master title to take longer than one with a title in the seller's name, because the developer's consent and records add a step.

## When Must a Developer Issue Strata Titles?

The Strata Titles Act sets deadlines for the land owner, usually the developer:

| Step | Deadline | Source |
| :--- | :--- | :--- |
| Apply for the **Certificate of Proposed Strata Plan (CPSP)** from JUPEM | Within **3 months** of the building's completion (plus 1 month extension on request) | Strata Titles Act 1985, s.8 |
| Apply to the Land Office for **strata titles** | Within **1 month** of CPSP approval (plus 1 month extension on request) | Strata Titles Act 1985, s.8 |
| **Penalty** for failing to apply | Fine of **RM10,000 to RM100,000**, or up to **3 years'** imprisonment, plus **RM100 to RM1,000 a day** for a continuing offence; the court can also order the developer to apply | Strata Titles Act 1985, s.8(7) |

The application also needs a Certificate of Completion and Compliance (CCC) or Certificate of Fitness (CF), and the building must sit within the lot boundaries. If the developer is wound up, the liquidator must file the application. (Source: JKPTG, *Soalan Lazim: Hakmilik Strata*, on the Strata Titles Act 1985 as last amended by Act A1518, in force nationwide from 1 January 2017; checked 30 Sep 2026.)

If your building has had its CCC for years and still has no strata titles, ask the JMB to write to the developer and the state land office, citing s.8. Our [JMB vs MC guide](/resources/jmb-vs-mc-strata-malaysia-2026) explains how the management body changes once titles are issued.

## 1. Perfection of Title & Perfection of Charge Workflow

When a unit bought under a **master title** receives its own strata or individual title, the owner must complete **perfection**:

1. **Perfection of transfer (Form 14A):** your lawyer registers a Memorandum of Transfer (Form 14A under the National Land Code) from the developer to you, so your name appears on the title.
2. **Perfection of charge (Form 16A):** if you have a housing loan, the bank's assignment is replaced by a registered charge (Form 16A) on the new title.

Legal fees for perfection follow the Solicitors' Remuneration Order, and MOT stamp duty must be settled when the transfer is stamped. Many developers and banks ask owners to perfect promptly, because an unperfected title makes a later sale or refinancing slower. Our [perfection of transfer and charge guide](/resources/perfection-of-transfer-charge-malaysia-2026) sets out the costs step by step.

## 2. Share Units (*Syer Unit*) & Maintenance Fee Calculation

Strata owners pay **Charges** (the maintenance fee) in proportion to their parcel's **allocated share units**, plus a **sinking fund contribution of at least 10%** of the Charges. The developer sets the Charges during the developer period, the JMB sets them after its first AGM, and the MC sets them at a general meeting once strata titles are issued. Payment is due within 14 days of the bill, and late interest is capped at 10% a year. (Source: Strata Management Act 2013, ss.25 and 60; checked 30 Sep 2026.)

**Monthly Charges = parcel share units x rate per share unit**
**Monthly sinking fund = at least 10% x monthly Charges**

### Worked Example (1,200 sq ft Condominium Unit)
- **Allocated share units:** 125.
- **Rate per share unit:** RM2.80 (illustrative; each building sets its own).
- **Monthly Charges:** 125 x RM2.80 = **RM350 a month**.
- **Monthly sinking fund (10%):** RM350 x 10% = **RM35 a month**.
- **Total:** **RM385 a month**, or RM4,620 a year. On a RM375,000 condo that is about 1.2% of the price every year.

Disputes over Charges, by-laws or defects in common property go to the **Strata Management Tribunal**, which hears claims of up to **RM250,000**. (Source: Strata Management Act 2013, s.105(1); checked 30 Sep 2026.) ## 3. Gated and Guarded Strata Landed Estates

A strata scheme is not only a tower. JKPTG defines a strata scheme as a multi-storey building **and/or land** subdivided into parcels within one lot, so a gated terrace or semi-D development can be issued strata titles for **land parcels**. (Source: JKPTG, *Soalan Lazim: Hakmilik Strata*; checked 30 Sep 2026.)

- **Common property:** the internal roads, guardhouse, perimeter fence, clubhouse and landscaping belong to the management body, not to the individual owners, and are paid for through the Charges.
- **By-laws apply:** the JMB or MC's by-laws can restrict façade changes, extensions, colour schemes and renovation hours, so check them before planning works.
- **It looks landed, but it is strata:** your title, bank documents and SPA will say strata. Budget for the monthly Charges and sinking fund on top of quit rent and assessment.

### SuperHomes Data: How Common Is Strata?

In Kuala Lumpur and Selangor, **270 of 314** active sale listings on SuperHomes (**86%**) are strata-type homes (condominium, service residence, apartment, flat or townhouse), with a median asking price of **RM375,000**. The 44 landed and other listings have a median asking price of **RM914,000**. (Source: SuperHomes listings, active residential sale listings in KL and Selangor, 30 Sep 2026; asking prices, not transaction prices.) For most buyers under RM500,000, strata is the realistic option. Compare strata homes in [KL City Centre](/area/kuala-lumpur/kl-city-centre) and [Cheras](/area/kuala-lumpur/cheras), or browse all [Selangor](/area/selangor) listings to see both title types side by side.

> **Note:** A listing's "freehold" or "leasehold" label is separate from its title type. A strata condo can be freehold, and a landed house on an individual title can be leasehold. See our [freehold vs leasehold guide](/resources/freehold-vs-leasehold-malaysia).

## Common Mistakes When Checking a Title

1. **Assuming a completed building has strata titles.** Many older buildings still sit on a master title. Ask for a land search or the developer's confirmation.
2. **Ignoring a qualified title.** HS(D) or HS(M) land is registered, but a developer cannot apply for strata titles until the final title is issued.
3. **Treating a landed gated home as individual title.** Check the SPA: strata landed homes carry Charges and by-laws.
4. **Delaying perfection.** An unperfected title slows the next sale or refinancing, and the bank may press you to complete it.
5. **Not checking share units.** Your Charges follow your share units, which are listed in the SPA's schedule of parcels. Compare units before you buy.

## Frequently Asked Questions (FAQ)

### Q: What is the difference between strata title and individual title?
An individual title gives you ownership of a land lot and the house on it, with no management body and no monthly Charges. A strata title gives you ownership of one parcel in a subdivided building or land, plus share units in the common property, managed by a JMB or MC that bills you monthly Charges and a sinking fund.

### Q: What does strata title mean in Malaysia?
It is the title document issued by the state land office for each parcel in a strata scheme under the Strata Titles Act 1985. The scheme can be a multi-storey building, subdivided land, or both. Your title shows your parcel and its share units.

### Q: What is a master title?
It is the single title over a whole development's land, held by the developer before individual or strata titles are issued. Buyers under a master title own their unit through the SPA and deeds of assignment, not through a registered title, until perfection.

### Q: What is the difference between qualified title and final title?
A qualified title (HS(D) or HS(M)) is issued before the land's final survey; a final title (Geran, Pajakan Negeri, Geran Mukim or Pajakan Mukim) is issued after it. Both are registered titles, but only land under final title can be subdivided into strata titles.

### Q: How long does a developer have to apply for strata titles?
Under s.8 of the Strata Titles Act 1985, the developer must apply for the Certificate of Proposed Strata Plan within 3 months of completion and for strata titles within 1 month of its approval, each extendable by 1 month. Failing to do so carries a fine of RM10,000 to RM100,000 or up to 3 years' imprisonment.

### Q: What fees do strata title owners pay?
Monthly Charges calculated on your share units, plus a sinking fund of at least 10% of the Charges, set by the developer, JMB or MC. On a typical 125-share-unit condo at RM2.80 per unit, that is about RM385 a month. You also pay quit rent and assessment.

### Q: Can a landed house be on strata title?
Yes. Many gated and guarded terrace, cluster and semi-D developments are issued strata titles for land parcels. The roads, guardhouse and fence are common property, and owners pay Charges and a sinking fund.

### Q: Can I sell my house if the strata title has not been issued yet?
Yes. You can sell a property under a master title by assigning your SPA rights to the buyer through a Deed of Assignment, usually with the developer's written consent. Expect the sale to take longer than one with an issued title.
