# Subletting & Co-Living Room Rental Malaysia 2026: Rules & Yields

**Subletting & Co-Living Room Rental Malaysia 2026: Rules & Yields**

Renting out a flat room by room is common in Malaysia. Students, interns and young workers often want a furnished room with bills included, not a whole unit. The model has two forms. In **owner-operated room rental**, you own the unit and let each room on its own agreement. In **subletting (rent-to-rent)**, you rent a whole unit from an owner on a master tenancy and let the rooms to sub-tenants.

This guide covers the rules and the day-to-day running of both: what the owner has to agree to in writing, the clauses a master tenancy needs, where strata by-laws and council rules come in, fire safety, and how to bill electricity without breaking the law. It ends with a worked example in ringgit. The example shows why the margin is often much thinner than "double your rent" marketing claims.

Two points before you start. First, Malaysia still has no residential tenancy statute (the Residential Tenancy Bill had not been tabled by 30 Sep 2026). The tenancy agreement, contract law and the National Land Code govern everything. Second, if you are weighing co-living as a property **investment** (which unit to buy, the price and the return on your cash), treat that as a separate decision. This guide is about running rooms legally once you have a unit.

## At a Glance: Whole Unit Rent vs. Co-Living Room Subletting

| Point | Whole-unit tenancy | Room-by-room (owner or master tenant) |
| :--- | :--- | :--- |
| **Legal basis** | One tenancy agreement between owner and tenant | Owner-operated: one agreement per room. Subletting: a master tenancy with **written consent to sublet**, plus one sub-tenancy per room |
| **Who pays the owner** | The tenant | The master tenant pays the full rent even when rooms are empty or a sub-tenant defaults |
| **Utilities** | Usually in the tenant's name | Usually stay in the owner's or master tenant's name. Air-con use is split with sub-meters at cost |
| **Strata by-laws** | Bind the tenant | Bind every occupant. The JMB or MC can fine anyone in breach, up to RM200 per breach |
| **Renovation** | Rarely needed | Adding a room needs a JMB/MC renovation permit and council plan approval. Banned in KL strata serviced apartments and SOHOs, and possibly in other KL strata buildings (see Section 1) |
| **Stamp duty** | One agreement | The master tenancy and every sub-tenancy are separate instruments to stamp |
| **Management effort** | Low | High: several contracts, turnover, cleaning, disputes between housemates |
| **Margin** | Rent minus owner's costs | Room rents minus master rent, vacancy and running costs. Often thin (see Section 4) |

## 1. Local Council Partition Rules (DBKL, UBBL & Strata By-Laws)

Adding a room is where most co-living set-ups run into trouble. Several layers of rules apply, and each needs its own approval.

### Key Municipal Council Compliance Guidelines

1. **Strata approval first.** In a condo or apartment, any renovation needs the JMB or MC's written approval under the building's by-laws. That usually means drawings, a renovation deposit and set working hours. See our guide to [strata renovation rules and JMB permits](/resources/condo-renovation-deposit-jmb-approval-rules-malaysia) for the usual process.
2. **Council approval for building works.** Under UBBL by-law 14(1), plans must be submitted for "additions or alterations, including a subdivision of rooms". The UBBL treats any internal wall as a partition. Under the Street, Drainage and Building Act 1974 (SDBA), altering a building without the council's permission can lead to a fine of up to RM25,000 and an order to alter or demolish the work (s.70(11)). (Source: Uniform Building By-Laws 1984, by-law 14; SDBA 1974, s.70; checked 30 Sep 2026.)
3. **Kuala Lumpur's partition ban.** DBKL's Commissioner of Buildings issued a circular on 21 July 2023, effective 1 August 2023, to all JMBs, MCs and sub-MCs in Kuala Lumpur. It **prohibits building walls to create extra bedrooms**. Reports differ on how far it reaches. NST reported it as covering **strata-titled serviced apartments and SOHOs**. EdgeProp reported it as covering **residential and commercial buildings with strata status** in DBKL's area, which would include ordinary condos. DBKL's reasons: the extra rooms breach the approved development order, cut natural light to living areas and raise occupancy (Source: NST, Aug 2023, and EdgeProp, 16 Aug 2023, both reporting the DBKL circular; checked 1 Oct 2026). If your KL unit is a serviced apartment or SOHO, the 4-room plan in Section 4 is not available. For any other strata unit in KL, ask your JMB/MC and DBKL how they apply the circular before you build.
4. **Light and ventilation.** UBBL by-law 39(1) requires every room to have windows totalling at least **10% of its clear floor area**, with openings that let air pass freely over at least **5% of that floor area** (Source: UBBL 1984, by-law 39(1); checked 30 Sep 2026). A windowless box room made by closing off part of the living room fails this test. It is also the room people find hardest to escape from in a fire.

**Fire safety.** We found no rule setting a required extinguisher type or size for a private residential unit. Fire certificates under the Fire Services Act 1988 are for premises designated under that Act, so ask Bomba if you are unsure about your building. Either way, a unit with five or six unrelated occupants is a higher fire risk than a family home, and your insurer and the owner will expect precautions. Sensible minimums:

- A battery smoke alarm in every bedroom and in the corridor outside the bedrooms.
- A portable extinguisher and a fire blanket in or near the kitchen.
- No padlocks or keyed deadlocks that trap people inside. Every bedroom door must open from the inside without a key.
- No partition that blocks the main door, a window or the route from any bedroom to the exit.
- Wiring changes for sub-meters and extra air-conditioners done by a wireman registered with Suruhanjaya Tenaga (the Energy Commission).

**Occupancy.** Strata by-laws may limit how many people can live in a parcel or ban "business use" of units. Read the building's additional by-laws before you commit. A management corporation can make additional by-laws on the use and enjoyment of parcels by special resolution and fine anyone in breach up to RM200 (Source: Strata Management Act 2013, s.70(2), and s.32(3) for JMBs; checked 30 Sep 2026). Some buildings go further. The Verve Suites house rule upheld by the Federal Court in 2020 banned short-term rentals and also any tenancy that **allows the tenant to sublet** (*Innab Salil & Ors v Verve Suites Mont' Kiara MC*, [2020] MLJU 1563).

## 2. The Master Tenancy Agreement: Essential Landlord Consent

Malaysia has no residential tenancy act yet. KPKT's Residential Tenancy Bill had not been tabled by 30 Sep 2026. On 4 Aug 2026 the Deputy Minister told the Dewan Negara it was "being finalised" (Source: The Star, 4 Aug 2026; checked 30 Sep 2026). So your rights come from the written agreement, the Contracts Act 1950 and the general law of landlord and tenant. If you sublet without permission when the agreement forbids it, the owner can terminate the tenancy for breach and claim damages. The sub-tenants' agreements are then only with you, not with the owner, so they can lose their rooms at short notice.

A standard Malaysian tenancy agreement nearly always says the tenant may not "assign, sublet or part with possession" of the premises without the landlord's prior written consent. **Get that consent in writing, in the agreement itself or in a signed addendum.** A WhatsApp "ok" from the owner is weak evidence if the relationship turns sour.

### Crucial Master Tenancy Clauses

- **Express permission to sublet:** The owner consents to the tenant subletting individual rooms. State the maximum number of rooms and occupants.
- **Use clause:** Residential use only. This also helps you stay within strata by-laws that ban "business" or short-term use. Co-living with 6 to 12 month room agreements is not the same as nightly letting. If you want to take nightly bookings, read our [Airbnb and short-term rental rules guide](/resources/airbnb-short-term-rental-regulations-malaysia) first.
- **Alterations and reinstatement:** Written approval for any partition, lock change or sub-meter, who pays for it, and whether you must restore the original layout when you leave.
- **Utilities:** Whose name the TNB and water accounts are in, who pays the deposits, and how sub-metered usage is charged to sub-tenants (at cost, see Section 3).
- **Liability and indemnity:** You remain liable to the owner for rent, damage and by-law fines caused by your sub-tenants.
- **Term and break clause:** A master term long enough to recover your set-up costs (see the worked example), and what happens to sub-tenancies if the master tenancy ends early.
- **Insurance:** Who insures the building and contents, and whether the owner's fire policy allows multiple unrelated occupants.
- **Stamp duty:** Stamp the master tenancy and every room agreement. Unstamped agreements cannot be used as evidence in court until stamped with a penalty. See our [tenancy agreement guide](/resources/tenancy-agreement-malaysia) for the current rates and the e-stamping steps.

On the sub-tenant side, each room agreement should state the room, the shared areas, house rules (guests, noise, cleaning rota), the deposit, the notice period, and how the electricity is charged. Keep a signed inventory with dated photos for each room. It is your best evidence in a deposit dispute.

## 3. Technology Infrastructure for Smart Co-Living Operations

- **Digital locks:** Keypad or app-based locks on the main door and bedroom doors let you issue and cancel codes when sub-tenants change. Keep a physical override. Make sure bedroom locks open from inside without a code.
- **Electricity sub-meters:** Air-conditioning is the largest variable cost in a shared unit. A sub-meter on each bedroom's air-con circuit lets you charge each sub-tenant for what they use. Have it installed by a registered wireman.
- **Charge electricity at cost.** Under the Electricity Supply Act 1990, only a licensed supplier may supply electricity to another person, unless exempted (s.9(1)). The Energy Commission can also fix maximum resale prices, and a person charged above that price can recover the excess (s.31) (Source: Electricity Supply Act 1990 (Act 447), Suruhanjaya Tenaga copy; checked 30 Sep 2026). The safe course: divide the actual TNB bill by the actual kWh and pass on that cost, with no margin. Put the method in each room agreement. Our [sub-meter installation and billing guide](/resources/landlord-submeter-installation-billing-malaysia) covers the hardware.
- **Water and internet:** These are usually shared and built into the room rent. Budget for them as fixed costs, as in the worked example below.
- **Records:** Keep rent receipts, utility bills and meter readings. As the owner, you report net rental income on Form BE. As a master tenant, what you make from subletting is income too. See our [rental income tax guide](/resources/rental-income-tax-malaysia-2026).

## 4. Profit Margin Worked Example (3-Bedroom Condo Conversion)

Most marketing for rent-to-rent quotes net yields of 10% or more. We could not find any published data behind those numbers, so here is a worked example you can check line by line. **Every input is labelled.** Only the master rent comes from data. Replace the assumptions with quotes for the unit you are looking at.

**Data point:** the median asking rent for a 3-bedroom condo, serviced residence or apartment in Setapak, Kuala Lumpur, is **RM2,000 a month** (SuperHomes rent listings dated Dec 2025 to Mar 2026, de-duplicated, n=78; median built-up about 915 sq ft). Setapak has large student and young-worker demand and many 3-bedroom high-rise units, which makes it a typical co-living test case. You can browse current [Setapak listings](/area/kuala-lumpur/setapak).

**Assumptions (not data):**

| Input | Scenario A: 3 rooms, no partition | Scenario B: 4 rooms, approved partition |
| :--- | :--- | :--- |
| Master rent paid to owner | RM2,000 / month (SuperHomes median above) | RM2,000 / month |
| Room rents (assumed) | RM1,100 master + RM850 + RM700 = RM2,650 | RM1,100 + RM850 + RM700 + RM650 = RM3,300 |
| Vacancy (assumed) | 1 month empty per room per year (1/12 of rent) | Same |
| Wi-Fi (assumed) | RM130 / month | RM130 / month |
| Common-area cleaning (assumed) | RM150 / month | RM150 / month |
| Water and common-area electricity you absorb (assumed) | RM120 / month | RM150 / month |
| Repairs and replacement reserve (assumed) | RM100 / month | RM150 / month |
| Set-up cost (assumed) | RM8,000: furniture, locks, sub-meters | RM14,000: the above plus partition, approvals, extra air-con |

Air-con electricity is billed to each sub-tenant at cost through the sub-meters, so it is left out of both sides.

**Annual result:**

| Line (per year) | Scenario A | Scenario B |
| :--- | :--- | :--- |
| Room rent at full occupancy | RM31,800 | RM39,600 |
| Less vacancy (1/12) | −RM2,650 | −RM3,300 |
| **Rent collected** | **RM29,150** | **RM36,300** |
| Less master rent (RM2,000 × 12) | −RM24,000 | −RM24,000 |
| Less running costs | −RM6,000 | −RM6,960 |
| **Net profit before tax and your own time** | **−RM850 (a loss)** | **RM5,340 (about RM445 a month)** |
| Set-up cost | RM8,000 | RM14,000 |
| **Years to earn back set-up cost** | Never at these rents | **About 2.6 years** |
| Room rents needed each month to break even | About RM2,730 | About RM2,815 |

**What the example shows:**

1. **Room rents must add up to well above the whole-unit rent.** Here the three rooms need about RM2,730 a month between them, roughly 36% above the RM2,000 master rent, just to break even once vacancy and running costs are counted.
2. **The margin comes from the extra room, and the extra room is the regulated part.** Scenario B only works because of the fourth room. That room needs JMB/MC approval, council plan approval and windows meeting UBBL by-law 39. In a KL serviced apartment or SOHO it is not allowed at all, and it may not be allowed in other KL strata buildings either (see Section 1). There, Scenario A is your realistic case.
3. **Match the master term to the payback.** A 2.6-year payback on a 2-year master tenancy means you hand the owner your improvements before you have earned your money back. Negotiate a 3-year term with a renewal option, or ask the owner to pay for the partition in return for a higher rent.
4. **Your time is not counted.** Finding sub-tenants, collecting rent, handling housemate disputes and managing repairs is real work.

**If you own the unit instead of renting it.** There is no master rent to pay, so compare room-by-room letting with letting the whole unit to one tenant at the RM2,000 median. The comparison only works if both sides carry the same kinds of cost, so:

- **Assumption (not data):** a whole-unit tenant also leaves the unit empty one month a year, and pays their own utilities and Wi-Fi.
- Maintenance fees, quit rent, assessment and insurance are the same either way, so they are left out of both columns.

| Line (per year) | Whole unit, one tenant | Scenario A (3 rooms) | Scenario B (4 rooms) |
| :--- | :--- | :--- | :--- |
| Rent collected, after 1 month vacancy | RM22,000 | RM29,150 | RM36,300 |
| Less running costs | RM0 | −RM6,000 | −RM6,960 |
| **Net before tax and your own time** | **RM22,000** | **RM23,150** | **RM29,340** |
| **Extra over whole-unit letting** | n/a | **RM1,150** | **RM7,340** |
| Set-up cost | RM0 | RM8,000 | RM14,000 |
| **Years for the extra income to repay set-up** | n/a | **About 7 years** | **About 1.9 years** |

On these assumptions, Scenario A barely beats a single tenant and takes about seven years to repay its set-up cost. Scenario B pays back in about two years, but only if the fourth room is approved. If a whole-unit tenant would actually leave the unit empty for less than a month a year, the gap narrows. To test your own figures, use the [rental yield calculator](/tools/rental-yield-calculator).

## Frequently Asked Questions (FAQ)

### Q: Is room subletting legal in Malaysia?
Yes, if the owner agrees. No law bans subletting as such. But almost every tenancy agreement forbids it without the landlord's prior written consent, and subletting in breach lets the owner terminate and claim damages. You must also follow the building's strata by-laws and your local council's rules on building works.

### Q: Can a tenant sublet a room without the landlord's permission?
Only if the tenancy agreement does not restrict subletting, which is rare. Standard agreements prohibit subletting, assigning or parting with possession without written consent. Get the consent in writing and state the number of rooms and occupants.

### Q: Can a condo JMB or MC ban co-living or room rentals?
A JMB or MC can make additional by-laws by special resolution to regulate the use and enjoyment of parcels, such as occupancy limits, tenancy registration and rules against business use. The fine for a breach is capped at RM200 (Strata Management Act 2013, ss.32(3) and 70(2)). In 2020 the Federal Court upheld Verve Suites' by-law, which banned short-term rentals and tenancies allowing subletting. It did not rule on long-term room tenancies as such. In KL, DBKL also bans extra-bedroom partitions in strata serviced apartments and SOHOs, and some reports say the ban covers all strata buildings in the city.

### Q: Do I need council approval to add a partition bedroom?
Usually, yes. UBBL by-law 14(1) requires plans for alterations "including a subdivision of rooms". Building without permission risks a fine of up to RM25,000 and a demolition order under s.70 of the Street, Drainage and Building Act 1974. In a strata building you also need the JMB/MC's renovation approval. In Kuala Lumpur, DBKL has banned extra-bedroom partitions in strata serviced apartments and SOHOs since 1 Aug 2023. Some reports say the ban covers all residential and commercial strata buildings in the city, so check before you build. Any new room needs windows of at least 10% of its floor area (UBBL by-law 39).

### Q: Can I charge sub-tenants more than the TNB rate for electricity?
Don't. Under the Electricity Supply Act 1990, supplying electricity to another person needs a licence unless exempted (s.9(1)). If a maximum resale price has been fixed, anyone overcharged can recover the excess (s.31). Charge air-con usage at the actual cost per kWh from the TNB bill and write the method into each room agreement.

### Q: Who pays if a sub-tenant damages the unit or stops paying rent?
You do, as master tenant. The owner's agreement is with you, so you owe the full rent and the cost of damage whatever your sub-tenants do. Recover it from the sub-tenant's deposit or claim against them, for example in the small claims procedure of the Magistrates' Court.

### Q: What net return can I expect from co-living?
It depends on the unit, and published double-digit yields rarely show their inputs. In our worked example, a 3-bedroom Setapak unit on a RM2,000 master rent loses money when let as three rooms. With a fourth, approved room it makes about RM5,340 a year before tax. Run your own numbers, including vacancy and set-up costs.

### Q: Do I pay tax on subletting income?
Yes. An owner declares net rental income under Section 4(d) of the Income Tax Act 1967. A master tenant's profit from subletting is also taxable. If you run several units with services, LHDN may treat it as a business under Section 4(a). See our rental income tax guide.
