# Water Leakage & Burst Pipe Repairs Landlord vs Tenant Malaysia 2026

In a Malaysian rental, the landlord usually pays to repair a burst concealed pipe, a leaking water heater or anything structural, while the tenant pays for minor items they use daily and for damage they caused, such as a toilet blocked with wipes. If water comes through the ceiling of a strata unit, the law presumes the leak comes from the unit above, and the building's management must inspect within 7 days of a complaint. The tenancy agreement decides the details, so read its repair clause first.

Leaks are one of the most common rental arguments because water damage spreads: a dripping pipe in the wall becomes peeling paint, swollen cabinets, a ruined mattress, a high water bill and an angry neighbour below. This guide explains who pays in each case, how the strata inter-floor leakage rules work, what repairs typically cost, and how to settle the extra water bill.

## Who Pays: Quick Reference

| Situation | Usually pays | Why |
| --- | --- | --- |
| Concealed pipe in wall or floor bursts | Landlord | Part of the building the tenant cannot reach or maintain |
| Water heater tank or pipe leaks from age | Landlord | Landlord's fixture, normal ageing |
| Tap washer, bidet hose, flexible hose wears out | Tenant (if agreement says minor repairs) | Daily-use consumables |
| Toilet or sink blocked by misuse | Tenant | Damage caused by the tenant |
| Tenant leaves tap running and floods unit | Tenant | Negligence |
| Leak through ceiling from the unit above (strata) | Owner of the unit above, or the management body if common property | Statutory presumption, see below |
| Leak from roof or external wall (strata) | Management body (JMB/MC) | Common property |
| Tenant's own furniture and electronics damaged | Whoever caused the leak, or tenant's own insurance | Landlord's fire/houseowner policy covers the building, not tenant goods |

Malaysia has no residential tenancy statute that sets repair duties yet; the proposed Residential Tenancy Act had not been passed or brought into force when we checked (source: KPKT statements on the Bill; checked 5 Oct 2026). Repair duties therefore come from the agreement and general contract law.

## Inter-Floor Leakage in Strata Buildings

For condos and apartments, the Strata Management (Maintenance and Management) Regulations 2015 contain a specific procedure for inter-floor leakage, meaning dampness, moisture or water penetration on the ceiling of a unit.

1. **Presumption.** The leak is presumed to come from the parcel directly above unless its owner proves otherwise.
2. **Complaint.** The affected owner, or the tenant through the owner, notifies the developer, Joint Management Body (JMB) or Management Corporation (MC) in writing.
3. **Inspection within 7 days.** The management body must inspect within 7 days of the complaint to find the cause and who must fix it. Owners must give access.
4. **Certificate within 5 days.** Within 5 days of the inspection, the management body issues a certificate of inspection stating the cause and the party responsible.
5. **Repair.** The responsible party must fix the leak. If they fail to, the management body can step in and recover the cost from them.

If the upstairs owner still refuses, the Strata Management Tribunal can hear claims between owners and management bodies for a modest fee and without lawyers. A tenant is not a parcel owner, so in a rental the landlord normally drives the process. For a full walkthrough, see [inter-floor water leakage tribunal claims](/resources/inter-floor-water-leakage-tribunal-claim-malaysia).

Many older guides call the complaint "Form 28". We could not confirm that form number against the Regulations' schedule for this update, so ask your management office for its leakage complaint form rather than relying on a number.

## What Leak Repairs Cost

Indicative 2026 Klang Valley contractor prices, not regulated figures:

| Job | Typical cost |
| --- | --- |
| Replace tap washer or cartridge | RM50 to RM150 |
| Replace bidet or flexible hose | RM60 to RM150 |
| Clear a blocked toilet or floor trap | RM120 to RM350 |
| Leak detection (thermal or pressure test) | RM300 to RM800 |
| Cut, repair and re-tile a concealed pipe | RM450 to RM1,800 |
| Bathroom floor waterproofing redo (strata leak to unit below) | RM2,500 to RM6,000+ |
| Ceiling board replacement and repaint below | RM400 to RM1,500 |

Rates in [Mont Kiara](/area/kuala-lumpur/mont-kiara) high-rises are often higher than in walk-up apartments because of access, parking and management approvals.

## Worked Example: Splitting the Cost and the Water Bill

A tenant in a [Cheras](/area/kuala-lumpur/cheras) condo notices a damp patch on the bathroom wall and a water bill that has jumped from its usual 18 m³ a month to 32 m³. A plumber finds a cracked concealed hot-water pipe.

| Item | Amount | Who pays |
| --- | --- | --- |
| Leak detection | RM400 | Landlord |
| Hack, replace pipe, re-tile | RM1,250 | Landlord |
| Extra water used (32 - 18 = 14 m³ above normal) | Billed at the state tariff for that band | Landlord, once the plumber confirms the cause |
| Tenant's damaged bathroom mat and toiletries | Small | Tenant, unless the landlord delayed after notice |

The fair way to settle the bill is to compare it with the tenant's normal usage from the previous three months and have the landlord cover the excess. Water tariffs vary by state and usage band, so use the rate shown on the actual bill rather than a fixed figure. If the tenant delayed reporting a visible leak for weeks, a split is reasonable.

## SuperHomes Data: Strata Homes and Rents

Of 3,440 recorded sales in Kuala Lumpur, 51.3% were condominiums, apartments or flats, so just over half of KL's recorded sales were strata units, the type of home the inter-floor leakage rules above cover.

Source: SuperHomes analysis of JPPH-recorded residential transactions, Kuala Lumpur, January 2024 to September 2025, extracted 14 October 2026.

Rent is the other half of the cost question. Median asking rents for condominiums, serviced residences, apartments and flats are:

| State | Median asking rent | Rent listings |
| --- | --- | --- |
| Kuala Lumpur | RM2,800 | 3,142 |
| Selangor | RM1,900 | 2,024 |
| Penang | RM2,300 | 1,185 |
| Johor | RM2,300 | 1,151 |

Source: SuperHomes listing database, condominium, serviced residence, apartment and flat rent listings, December 2025 to March 2026, extracted 14 October 2026.

Set against these rents, the worked example's RM1,650 repair bill (RM400 for detection plus RM1,250 for the pipe) is about 59% of KL's median monthly asking rent and about 87% of Selangor's. A concealed-pipe repair can therefore cost most of a month's rent, and the burden is heaviest relative to rent in Selangor, which has the lowest median of the four states.

## What Tenants Should Do When a Leak Starts

1. **Stop the water.** Turn off the main valve or the heater isolator if it is safe.
2. **Report in writing the same day.** WhatsApp the landlord with photos and video. A written report protects you from a later claim that you caused the damage by delay.
3. **Protect your belongings.** Move electronics and furniture; your own items are your risk unless someone else caused the leak.
4. **Do not hire a contractor for structural work without consent,** unless it is an emergency and the agreement allows it. Keep receipts.
5. **For a ceiling leak in a strata unit,** ask the landlord to complain to management in writing, or tell the management office yourself and copy the landlord.

## What Landlords Should Do

- Respond quickly. A delayed repair can turn a RM500 job into a RM5,000 one and give the tenant a claim for their damaged belongings.
- Keep a list of plumbers and the management office contact for the tenant.
- Put a clear repair clause in the agreement: tenant pays minor repairs up to a stated limit (RM150 to RM300 is common), landlord pays structural, concealed pipe and water heater repairs.
- Check your fire/houseowner insurance for water damage cover; many policies cover sudden bursts but not gradual seepage.

## Before You Rent: Spotting Leak Risk

Water problems are easier to avoid than to argue about. When viewing a unit, look up at the bathroom and kitchen ceilings for yellow rings, bubbling paint or replaced ceiling boards, which often mean a past inter-floor leak. Run the shower for a minute and check the floor trap drains. Ask the landlord or agent whether the unit has had leaks and whether the upstairs unit has redone its waterproofing. In older walk-ups and apartments, also check the age of the water heater and ask when it was last replaced.

Record what you find in the inventory with photos. If there is an existing stain, note it, so nobody blames you for it at move-out. Units in newer buildings are not immune: shrinkage cracks and poorly sealed bathroom floors can appear in the first few years, often still under the developer's defect liability period, which the owner can use instead of paying for repairs.

## FAQs

### Q: Who pays for a burst pipe in a rented house in Malaysia?

Usually the landlord, if the pipe is concealed in the wall or floor or has failed through age. The tenant pays only if they caused the burst, for example by damaging the pipe during unauthorised drilling, or if the agreement clearly puts that repair on them.

### Q: Who is responsible for a ceiling leak from the unit above?

Under the strata inter-floor leakage rules, the leak is presumed to come from the unit directly above, and that owner must fix it unless they prove otherwise. The management body must inspect within 7 days of a written complaint.

### Q: Does the tenant have to pay the high water bill caused by a hidden leak?

Not for the extra caused by a hidden leak they could not see. The usual approach is for the landlord to pay the usage above the tenant's normal monthly average, once a plumber confirms the leak.

### Q: Can a tenant deduct repair costs from the rent?

Only if the agreement allows it or the landlord agrees in writing. Otherwise, pay rent as usual, report in writing and claim the cost separately; withholding rent can put the tenant in breach.

### Q: What if the upstairs owner refuses to let anyone inspect?

Report it to the JMB or MC, which has powers under the strata rules to require access and to carry out repairs and recover the cost. The landlord can also file a claim with the Strata Management Tribunal.

### Q: Does the landlord's insurance cover the tenant's damaged belongings?

Generally no. A landlord's fire or houseowner policy covers the building and the landlord's fixtures. Tenants need their own householder or contents policy, or a claim against whoever caused the leak.

### Q: How do I find a hidden leak?

Turn off every tap and watch the water meter. If it keeps moving, there is a leak. A plumber can then use thermal imaging or a pressure test to find it without hacking large areas.

### Q: How fast must a landlord fix a leak?

The agreement may set a time; if not, within a reasonable time given the urgency. An active leak that is damaging the unit or a neighbour's ceiling should be dealt with within days, not weeks.
