# Housing Loan Lock-In Period & Early Settlement Penalty Malaysia 2026

**Housing Loan Lock-In Period & Early Settlement Penalty Malaysia 2026**

A housing loan lock-in period is the stretch, usually the first three to five years, during which your bank charges an early settlement fee if you fully repay, refinance or sell and redeem the loan. The fee is set by your letter of offer, not by law, and is commonly quoted at 2% to 3% of the loan. Some packages have no lock-in at all.

Homeowners planning to sell, refinance or make a full lump-sum settlement must check their **lock-in period (*tempoh tertutup*)** before they act. A 2% to 3% fee on a RM400,000 loan is RM8,000 to RM12,000, and a "zero moving cost" package can add a clawback of the legal and valuation fees the bank paid for you.

This guide covers how lock-in penalties are calculated, how clawback clauses work, when the lock-in clock starts, and how to avoid paying. If you want to pay down your loan faster without closing it, read our [housing loan early settlement and principal payoff guide](/resources/housing-loan-early-settlement-payoff-malaysia-2026) instead; partial prepayments are a different question.

## At a Glance: Bank Lock-In Period & Penalty Structure Matrix (2026)

| Item | What you will typically see | Where to check |
| :--- | :--- | :--- |
| **Lock-in duration** | None, or commonly 3 to 5 years from disbursement | Letter of offer; "Lock-in Period & Early Termination Fee" line of the Product Disclosure Sheet (PDS) |
| **Early settlement fee** | Commonly quoted at 2% to 3%, on either the approved loan limit or the outstanding balance | Letter of offer / facility agreement |
| **Clawback** | Legal, valuation or stamp duty costs the bank absorbed, repayable if you redeem inside the lock-in | "Zero moving cost" or "free legal fees" package terms |
| **Partial prepayment** | Usually allowed without penalty as long as the loan stays open | Flexi / semi-flexi terms in the PDS |
| **No lock-in example** | Public Bank HOME Plan PDS: "Lock-in Period & Early Termination Fee: Not applicable" | Public Bank PDS, checked 30 Sep 2026 |

Malaysian housing loan PDS templates carry a "Lock-in Period & Early Termination Fee" line, so the terms are disclosed before you sign. Public Bank's HOME Plan PDS, for example, states "Not applicable" (Source: Public Bank HOME Plan Product Disclosure Sheet; checked 30 Sep 2026). CIMB's Home Flexi PDS (version Dec 2025) does not list a lock-in; any lock-in on a specific approval is set out in your letter of offer (Source: CIMB Home Flexi PDS, Dec 2025; checked 30 Sep 2026). The 2% to 3% range and three-to-five-year period are common market terms that vary by bank, package and customer, so treat them as a starting point, not a rule.

Pricing context: loans are priced off the **Standardised Base Rate (SBR)**, which follows BNM's Overnight Policy Rate of **2.75%**, held on 3 September 2026 (Source: BNM Monetary Policy Statement, 3 September 2026; checked 30 Sep 2026). Public Bank's PDS illustration uses an effective rate of 4.10% and CIMB's uses SBR + 2.35% (5.10%), both over 35 years, so moving to a lower spread is the usual reason people run into lock-in fees.

## 1. Penalty Calculation Formulas

Malaysian banks calculate early settlement fees on one of two bases. Your facility agreement says which one applies.

### Formula A: Percentage of Outstanding Loan Balance

**Penalty = outstanding balance on the settlement date × penalty rate**

### Formula B: Percentage of Original Approved Loan Amount

**Penalty = approved loan limit × penalty rate**

Formula B is always the more expensive of the two, because your balance only falls after disbursement.

### Worked Example (Refinancing at Year 2 of 3-Year Lock-In)

Take a Kuala Lumpur home at the SuperHomes median asking price of **RM462,000** (n=137; SuperHomes listings, active sale listings, 30 Sep 2026; asking prices, not transacted prices), financed at 90%:

- **Approved loan:** RM415,800 over 35 years at 4.10%, an instalment of about **RM1,866** a month (SuperHomes calculation).
- **Outstanding balance after 24 months:** about **RM404,679**.

| Penalty basis | 2% rate | 3% rate |
| :--- | :--- | :--- |
| Formula A: outstanding balance (RM404,679) | **RM8,094** | **RM12,140** |
| Formula B: approved limit (RM415,800) | **RM8,316** | **RM12,474** |

Two years in, the difference between the formulas is small; the rate matters far more than the basis. Browse current [Kuala Lumpur listings](/area/kuala-lumpur) to see how this scales for your own target price.

### Quick Early Loan Settlement Calculator

To estimate your own exit cost in five minutes:

1. Get your **outstanding balance** from your latest statement or a formal redemption statement (CIMB, for example, charges **RM50** per redemption statement on its Home Flexi loan; Source: CIMB Home Flexi PDS, Dec 2025; checked 30 Sep 2026).
2. Find the **penalty rate and basis** in your letter of offer.
3. Multiply: balance or limit × rate.
4. Add any **clawback** amount (section 2).
5. Compare the total with the interest you would save by refinancing, or the profit you would make by selling now rather than after the lock-in ends.

## 2. Bank Clawback Clauses (*Klausul Tuntut Semula*)

When you take a "zero moving cost" or "free legal fees" package, the bank pays some of your upfront costs: legal fees on the loan documents, the valuation fee and sometimes the loan stamp duty. If you redeem inside the lock-in, the clawback clause lets the bank recover those costs on top of the penalty.

**Total lock-in exit cost = early settlement fee + absorbed legal fees + absorbed valuation fee + any other absorbed cost named in the offer letter**

What the absorbed costs are worth on the RM415,800 loan above:

| Absorbed cost | How it is set | Amount |
| :--- | :--- | :--- |
| Legal fee on the loan agreement | Solicitors' Remuneration Order 2023: 1.25% of the first RM500,000 | about **RM5,198**, plus 8% service tax (about RM416) |
| Loan agreement stamp duty | 0.5% of the loan amount | **RM2,079**, or RM0 if you qualify for the first-home exemption on a home up to RM500,000 |
| Valuation fee | Board of Valuers scale | varies with value; ask for the actual invoice |

(Sources: Solicitors' Remuneration Order 2023, Third Schedule scale as reproduced in Malaysian Bar Circular No 258/2023; Public Bank HOME Plan PDS, stamp duty "Ad valorem 0.5% of loan amount"; Stamp Duty (Exemption) (No. 2) Order 2021 read with P.U. (A) 449/2025, covering loans for a first home up to RM500,000 with the SPA signed by 31 Dec 2027; checked 30 Sep 2026.)

On a zero-moving-cost package, a year-two exit could therefore cost RM8,000 to RM12,500 in penalty plus RM5,600 or more in clawed-back legal fees. Ask the bank for the clawback figure in writing before you sign the offer.

## 3. When Does the Lock-In Clock Start Ticking?

The lock-in runs from the date your facility agreement names. Two definitions are common:

1. **From the first disbursement.** Typical for completed subsale homes, where the bank releases the loan to the seller's side in one go, so first and full disbursement happen together.
2. **From full disbursement, or from the date of the loan agreement.** For an under-construction home, the bank releases the loan in stages against the progress billing schedule. If your lock-in counts from full disbursement, it only starts when the final stage is paid, often around vacant possession.

> **Warning:** For a new launch, a three-year construction period plus a three-year lock-in that starts only at full disbursement means about six years from signing the SPA before you can refinance or sell without a fee. Read the definition of "lock-in period" in your offer letter before you sign.

## 4. How to Avoid or Reduce a Lock-In Penalty

1. **Choose a package with no lock-in** if you might sell or refinance within five years. Public Bank's HOME Plan PDS shows such packages exist; the trade-off may be a slightly higher spread.
2. **Wait it out.** If the lock-in ends in a few months, the interest you save by refinancing now rarely beats a fee of RM8,000 or more.
3. **Prepay without closing.** Partial prepayments into a flexi or semi-flexi account usually do not trigger the fee, as long as the account is not reduced to zero and closed.
4. **Ask for a waiver when you move with the same bank.** Some banks waive or rebate the fee if you sell and take your next housing loan with them. This is a commercial concession, not a right, so get it in writing.
5. **Negotiate the sale timing.** When selling, set the SPA completion date after your lock-in expires; the buyer's loan redeems yours at completion, not at signing.
6. **Count the full cost before refinancing.** Add the penalty, clawback, new legal fees, valuation and stamp duty. Our [refinancing vs top-up loan guide](/resources/refinancing-vs-top-up-loan-malaysia-2026) has a break-even method.

## 5. Common Mistakes

- **Assuming the lock-in starts at SPA signing.** For under-construction homes it often starts at full disbursement.
- **Ignoring the clawback.** The headline 2% or 3% is only part of the exit cost on a zero-moving-cost package.
- **Setting completion inside the lock-in.** The fee is triggered when the loan is redeemed, so the completion date matters more than the signing date.
- **Relying on a verbal waiver.** Only a letter from the bank counts.
- **Forgetting partial prepayment rules.** On some loans, extra money first settles arrears and charges, and only reduces principal if you ask. CIMB's Home Flexi Smart PDS says you "must request a reduction in the principal Facility sum" (Source: CIMB Home Flexi Smart PDS; checked 30 Sep 2026).

## Frequently Asked Questions (FAQ)

### Q: What is the lock-in period for a housing loan in Malaysia?

It is the period, commonly the first three to five years, during which your bank charges a fee if you fully settle, refinance or redeem the loan. There is no statutory lock-in: each bank sets it in the letter of offer, some packages have none (Public Bank's HOME Plan PDS lists "Not applicable"), and the PDS discloses it before you sign.

### Q: How much is the housing loan lock-in penalty?

Commonly 2% to 3%, charged either on the approved loan amount or on the outstanding balance. On a RM415,800 loan two years in, that is about RM8,100 to RM12,500. Zero-moving-cost packages can add a clawback of the legal and valuation fees the bank paid.

### Q: Is there an early loan settlement calculator for Malaysia?

You can do it by hand: take your outstanding balance (or approved limit, if that is the basis), multiply by the penalty rate in your offer letter, then add any clawback. Request a formal redemption statement from your bank for the exact settlement figure on a chosen date; CIMB charges RM50 per statement on its Home Flexi loan.

### Q: Does making partial extra principal payments trigger a lock-in penalty?

Usually not. Extra payments into a flexi or semi-flexi account reduce your balance without closing the loan, so the early settlement fee does not apply. Check your facility agreement, because some loans require a written request before extra payments reduce principal.

### Q: How can I check when my housing loan lock-in period expires?

Read the "early settlement" or "lock-in period" clause in your facility agreement and letter of offer, and note whether it counts from first disbursement, full disbursement or the agreement date. If it is unclear, ask your bank for written confirmation of the expiry date.

### Q: Can lock-in penalty fees be waived during a property sale?

Sometimes. Some banks waive or rebate the fee if you take a new housing loan with them for your next home, and a buyer may agree to a later completion date so the redemption falls after the lock-in ends. Neither is guaranteed, so get any waiver in writing.

### Q: Do I pay the lock-in penalty if I refinance with the same bank?

It depends on the bank. A repricing with the same bank may be treated differently from a full redemption, but a new facility that pays off the old one inside the lock-in can still trigger the fee. Ask for the answer in writing before you apply.

### Q: Does the lock-in penalty apply to Islamic home financing?

Islamic financing can also carry a lock-in and an early settlement charge. Separately, your settlement amount is based on the outstanding balance after the rebate (*ibra'*) the bank grants on early settlement, not on the full contracted sale price (Source: CIMB Flexi Home Financing-i PDS, Dec 2025, "Bank's Sale Price subject to Ibra'/Rebate"; checked 30 Sep 2026).
